West Palm Beach Motorcycle Accidents

If you’re a motorcyclist in South Florida, you know there is no better feeling than cruising down the open road on a sunny day with the wind at your back. Although you always take the proper precautions, like wearing your helmet and gear, you accept the risk of motorcycle accidents because you love to ride. The odds of being involved in a motorcycle accident are even greater in South Florida, thanks to year-round warm weather and an abundance of motorcyclists. In fact, Florida has nearly 600,000 registered motorcycle drivers, the second-highest in the nation.  According to the National Highway Traffic Safety Administration, 97 percent of motorcycle fatalities occurred in clear conditions in 2017, and in that same year, Florida had the most motorcycle deaths from motorcycle accidents.

Common Injuries From Motorcycle Accidents

Because motorcycles offer little protection for riders, motorcycle accidents tend to be rather serious and often fatal. While it’s impossible to list every potential injury you could sustain in motorcycle accidents, the most common are:

  • Head Injuries, Including Concussions & Cracked Skulls
  • Traumatic Brain Injuries (TBI)
  • Broken Bones
  • Loss of A Limb or Appendage
  • Mild Bruising, Cuts, or Scrapes
  • Severe Gashes, Muscle Damage & Nerve Damage
  • Temporary/Permanent Paralysis

MOTORCYCLE ACCIDENT CLAIM BASICS

Under Florida law, motorcycle drivers must take a Basic Rider Course (BRC) to obtain a “Motorcycle Also” endorsement or “Motorcycle Only” license. However, unlike four-wheeled vehicles in Florida, personal injury protection (PIP) is not mandatory for motorcycles. If you are involved in a motorcycle accident due to someone else’s negligence, be aware that South Florida motorcyclists are not entitled to PIP. Even if you have “Medical Payments” (Medpay) coverage, it will only cover your medical bills up to a certain amount. If you’re on Medicare or Medicaid, Medicare may cover you for medical bills, while Medicaid will pay medical bills after a motorcycle accident. To protect your rights, contact an experienced  motorcycle accident attorney.

A South Florida motorcyclist may be entitled to pain and suffering damages without having a permanent injury but the motorcyclist must prove that a negligent party caused the motorcycle injuries. In most cases, the motorcyclist has four years to file a claim, although the deadline may be shorter if the federal government caused the crash. Regardless of the situation, your attorney will work hard to ensure you get the settlement you deserve.

Motorcycle Accidents

In South Florida, most motorcycle accidents are entirely avoidable. The most common causes of South Florida motorcycle accidents are cars turning left, drunk driving, riding in other vehicles’ blind spots and not making yourself visible, lane splitting, and dangerous road conditions. Riders who take caution and avoid perilous situations increase their chances of avoiding a motorcycle accident. However, no matter how careful a motorcyclist is on the highway, some collisions are inevitable. If you sustained injuries from a crash caused by someone else’s negligence, you can file a claim against the responsible party.
