Of the more than 11 million residents in the state of Florida, about 461,000 receive social security disability benefits. To qualify for  Florida Social Security Disability benefits, you must meet the Social Security

Administration’s (SSA) guidelines for disability. According to the SSA definition, to meet the requirements you must have a severe medical condition that is anticipated to last more than one year or may result in death;  you must be unable to perform your past relevant work or your past jobs that you performed before becoming disabled; and are unable to perform any other type of work in the national economy. In addition to fulfilling the Social Security Administration’s definition of disability, you must have worked and paid taxes for a long enough period of time to qualify for Social Security Disability coverage or be a low-income individual.

SOCIAL SECURITY DISABILITY CLAIMS BASICS

Whether you choose to apply online, by phone, or in person with DiBiaggio Law,  we have outlined the Social Security Administration’s process below or “what to expect”: 

  • Gather the required information and documents to apply. The SSA provides an Adult Disability Checklist designed to help you compile the information you need to complete the application.
  • Complete and submit your application.
  • Once the SSA receives your application, they will review it to ensure you meet some basic requirements for disability benefits.
  • The SSA verifies whether you have worked enough years to qualify or whether you qualify for low income disability benefits.
  • The SSA evaluates your current work activities, if any.
  • The SSA reviews your application and forwards your case to the office ofDisability Determination Services office in Florida.
  • The Office of Disability Determinations reviews your medical records and supporting documentation and renders a decision. If you are denied, DiBiaggioLaw will file a Request for Reconsideration. If you are denied on Reconsideration, DiBiaggio Law will file a Request for Hearing before an Administrative Law Judge. You will then attend a hearing with an experienced attorney from DiBiaggio Law

SOCIAL SECURITY DISABILITY

  • Every year in the state of Florida, thousands of people apply for Social Security Disability benefits because of an unexpected long-term or permanent disability. Regrettably, the SSA denies about 65 percent of the initial  Social Security Disability applications. Most  Security Disability applicants are also denied disability benefits at the first stage of the appeal process, known as the Request for Reconsideration. In order for most South Florida Social Security Disability applicants to receive disability benefits from the SSA, they must request a hearing before an administrative law judge, which can take as long as 600 days to schedule. 
  • Once an administrative law judge hears your case, it takes another 45 to 90 days to receive a decision on claim. In South Florida, the Office of Hearings and Operations (OHO) is the Social Security agency in charge of managing Social Security Disability hearings. For South Florida residents, there are OHO offices in Miami, Fort Lauderdale, and West Palm Beach
